1. These General Conditions will expressly regulate the relationships between Rainforest Chicza S.A. de C.V. (hereinafter, "CHICZA") and third parties (hereinafter, "Users") who register as users and / or purchase products through the online store of the official website of CHICZA https: //www.chicza .com, hereinafter the "Store").

2. OBLIGATIONS OF THE USER
2.1. The User undertakes, in general, to use the Store, to purchase the Products and to use each of the Store's services diligently, in accordance with the law, morals, public order and the provisions of these Conditions General, and you must also refrain from using them in any way that may prevent, damage or impair the normal operation and enjoyment of the Store by Users or that could injure or cause damage to the goods and rights of CHICZA, its suppliers, Users or in general of any third party.

3. PRODUCTS AND PRICES
3.1. CHICZA reserves the right to decide, at any time, the Products that are offered to Users through the Store. In particular, CHICZA may at any time add new Products to those offered or included in the Store, it being understood that unless otherwise provided, such new Products will be governed by the provisions of these General Conditions. Likewise, CHICZA reserves the right to stop providing or facilitating access and use at any time and without prior notice of any of the different classes of Products offered in the Store.

3.2. The Products included in the Store will correspond in the most reliable way possible that the web display technology allows to the Products actually offered. The characteristics of the Products and their prices appear in the Store. The prices indicated in the Store are in Mexican pesos and include VAT, unless otherwise indicated.

4. PROCEDURE AND FORM OF PAYMENT OF THE PRODUCTS
4.1. Within a maximum period of twenty-four (24) hours, CHICZA will send an email to the User, confirming the purchase, and will detail the characteristics of the Product, its price, the shipping costs and the data of the different options to make the payment of the Products to CHICZA if the same had not been done before.

4.2. The User who purchases a product through the Store must make the payment through the payment systems specifically detailed in the Store.

4.3. CHICZA will archive the electronic documents in which the contract is formalized, sending a copy to the User once the purchase is made. The contract will be made in the Spanish language.

4.4. The order confirmation sent by CHICZA is not valid as an invoice, only as proof of purchase. CHICZA will send the corresponding invoice together with the Product or by email.

5. RIGHT OF RETURN
5.1. The user has a right of withdrawal by which he may return any product and withdraw from the purchase within a period of no more than fifteen (15) calendar days, counted from receipt of the Product. Any return or exchange will have a surcharge of $ 300 MXN for transportation costs that will be assumed by the client, which will be discounted from the amount to be returned. Once this period of time is exceeded, the client must communicate the reason for the return to info@chicza.com, so that we can determine if the return is possible or not, in any case after these 15 days, the client must pay the expenses of transportation caused by such a return amounting to $ 400 MXN and through one of our transportation agencies.

The Product / s to be returned must be sent properly packed, in the same packaging sent, in perfect condition and without having been used or manipulated together with a copy of the delivery note.

5.2. The withdrawal entails the refund of the amount paid, less the transport costs assumed by the client and that amount to $ 500 MXN

5.3. The right of withdrawal may not be exercised when the Product is not returned in its original packaging or when it is not in perfect condition or it is a personalized product under the customer's instructions.

5.4. The right of withdrawal may not be exercised when the Product has been personalized at the customer's request. In these cases, the return of the product will only be accepted in the event of an error or product defect.

5.5. CHICZA will manage the order to return the price and shipping costs through the same payment system used by the Client for the acquisition of the Products, within a period of forty-eight (48) hours from the confirmation of arrival at the warehouse of the returned order. and, in any case, within a period of no more than 14 calendar days after the Client communicated his withdrawal. The application of the refund of the price and shipping costs on the Customer's account or card will depend on the card and the issuing entity. The term of application of the refund of the price will be up to seven (7) calendar days for debit cards and up to thirty (30) calendar days for credit cards.

5.6. The Customer will have the right to reimbursement of the price, shipping costs and transport costs of the return of defective Products or Products delivered if they do not correspond to the order placed by the Customer, in accordance with applicable legislation.

7. HOME DELIVERY SERVICE
7.1. The territorial scope of sales through the Store is exclusively for the territory of Mexico, so the delivery service will only be for that territory. The Products purchased through the Store will be sent to the delivery address that the User indicates once the payment has been verified, the maximum delivery period being thirty (30) days established by default in the Law.

7.2. CHICZA's delivery service is carried out in collaboration with different logistics operators of recognized prestige. Orders will not be served in PO Boxes or in hotels or other non-permanent addresses.

7.3. The cost of shipping is not included in the price of the Products. At the time of acquisition of the Product, the User will be informed of the exact shipping cost.

8. INTELLECTUAL AND INDUSTRIAL PROPERTY
8.1. The User acknowledges that all the elements of the Store and each of the Products, the information and materials contained therein, the brands, the structure, selection, ordering and presentation of their contents, and the computer programs used in relation to With them, they are protected by the intellectual and industrial property rights of CHICZA itself or of third parties, and that the General Conditions do not attribute to it, with respect to said industrial and intellectual property rights, any other right other than those specifically contemplated therein.

8.2. Unless authorized by CHICZA or, where appropriate, by the third party holders of the corresponding rights, or unless this is legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, loan, put available, or allow access to the public through any form of public communication of any of the elements referred to in the previous paragraph.

8.3. The User must refrain from circumventing or manipulating any technical devices established by CHICZA or by third parties in the Store.

9. DATA PROTECTION
9.1. In compliance with Law 15/99 LOPD, we inform you that your personal data and other information provided through the registration form, as well as that from the transactions carried out, will be included and kept in a file for processing, owned by DY kids , as long as its cancellation is not requested. 10. PASSWORDS
10.1. CHICZA will facilitate the use of personal passwords for the user who registers as such on the website. These passwords will be used to access the services provided through the Website. The user must keep the passwords under her exclusive responsibility in the strictest and absolute confidentiality, assuming, therefore, how many damages or consequences of all kinds derive from the breach or disclosure of the secret. 11. COOKIES
11.1. 12. APPLICABLE LAW AND JURISDICTION
These general conditions are governed by Spanish law. Any controversy arising from the interpretation or execution that may arise in relation to the validity, interpretation, fulfillment or resolution of this contract will be submitted to the Jurisdiction and Competence of the Courts and Tribunals of Mexico, waiving any jurisdiction that may correspond to the User, provided that the applicable legislation allows it.
